FULL TERMS & CONDITIONS:

These Walgreens Gift Card Terms and Conditions ("Gift Card Terms") govern your use of Walgreens Gift Cards, both tangible and eGift Cards (collectively, "Gift Cards"), which are issued by and solely an obligation of Walgreen Co. ("Walgreens" or "we" or "us"). These Gift Card Terms constitute a binding agreement between you and Walgreens. IMPORTANT: THESE GIFT CARD TERMS AFFECT YOUR LEGAL RIGHTS AND OBLIGATIONS AND INCLUDE A BINDING CONFIDENTIAL ARBITRATION CLAUSE, A WAIVER OF YOUR RIGHT TO PARTICIPATE IN CLASS ACTIONS, AND A WAIVER OF YOUR RIGHT TO A JURY TRIAL. BY PURCHASING, USING, OR ACCEPTING A GIFT CARD, YOU ACCEPT AND AGREE TO BE BOUND BY THESE GIFT CARD TERMS. If you do not agree with these Gift Card Terms, do not purchase, use, or accept a Gift Card.

  1. REDEMPTION: Gift Card can only be used for purchases of eligible merchandise at participating Walgreens or Duane Read locations in the United States, Puerto Rico and the U.S. Virgin Islands or online at Walgreens.com. Eligible goods and services are subject to change in Walgreens’ sole discretion. Gift Cards cannot be used to purchase other Gift Cards, prepaid open loop gift cards, third-party gift cards, open loop prepaid cards/banking products, or other financial services, including, but not limited to, FedEx, Transit, Remittance, Virtual Banking Products and Stamps. Gift Cards cannot be: (a) reloaded; (b) resold; (c) used for payment outside of Walgreens; (d) used for unauthorized advertising, marketing, sweepstakes, promotional or commercial purposes; (e) redeemed for more than face value; (f) transferred for value; (g) redeemed for cash unless required by law; or (h) used in a manner otherwise prohibited by law. Gift Card has no value until activated. Walgreens reserves the right to refuse to honor any Gift Card in the event of a disputed credit card charge, bounced check or other failure of consideration.
  2. BALANCE INQUIRIES. You can check your Gift Card balance by visiting a participating Walgreens or Duane Reade location, checking your receipt, calling Customer Care toll free at 1-833-522-2487, or clicking MyRetailCard opens in a new tab. The balance you receive when inquiring is an estimate only. In most cases, the balance is adjusted immediately when you make a purchase, but there may be occasions when the balance adjustment is delayed.
  3. NO REFUNDS OR RETURNS. Except as required by law, Gift Cards are non-refundable and cannot be returned or redeemed for cash. Unused Gift Cards purchased from third-party retailers are subject to the Gift Card return policies of such retailers.
  4. LOST, STOLEN, OR DESTROYED GIFT CARDS. Walgreens is not responsible for any lost, stolen, or destroyed Gift Cards, or if Gift Card is used without permission.
  5. DEACTIVATION OR SUSPENSION. Walgreens reserves the right, without notice, to void a Gift Card without refund, suspend or terminate the ability to use our services, cancel or limit orders, and bill alternative forms of payment if Walgreens suspects that a Gift Card is obtained or used fraudulently, unlawfully, or otherwise in violation of these Gift Card Terms.
  6. EXPIRATION AND ESCHEAT. Except as otherwise provided in these Gift Card Terms, Gift Cards do not expire. Walgreens may be required to remit the cash value of a Gift Card's unused balance to a state agency pursuant to the state's abandoned property or escheat laws. If we have remitted the unused balance of your Gift Card to such a state, the Gift Card will have a zero balance in our records and you will no longer be able to redeem the Gift Card; however, you may be able to file a claim to reclaim your escheated property. Please contact your state's unclaimed property department for guidance.
  7. NO FEES. No fees for inactivity or service fees apply to any Gift Cards.
  8. RESALE. Resale of Gift Cards to third parties for cash or other consideration is prohibited, although you may transfer a Gift Card to a third party as a gift. Gift Card is not valid and will not be honored, and Walgreens will not be liable, if Gift Card is obtained from unauthorized sellers or resellers, including through Internet auction sites.
  9. MAXIMUM VALUE. The maximum value of a Gift Card is $500. In addition, you may not purchase or obtain multiple Gift Cards with a total value of more than $750 in any one day.

  11. DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY. TO THE FULLEST EXTENT PERMITTED BY LAW, THE GIFT CARDS AND ALL RELATED PRODUCTS AND SERVICES ARE PROVIDED "AS IS" WITHOUT ANY REPRESENTATION OR WARRANTY, EXPRESS, IMPLIED, OR STATUTORY, OF ANY KIND, INCLUDING WARRANTIES OF MERCHANTABILITY, NONINFRINGEMENT, OR FITNESS FOR ANY PARTICULAR PURPOSE.

    TO THE FULLEST EXTENT PERMITTED BY LAW, WALGREENS, ITS AFFILIATES, AND THEIR RESPECTIVE DIRECTORS, MEMBERS, OFFICERS, EMPLOYEES, AGENTS, AND VENDORS SHALL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND, UNDER ANY THEORY OF LAW OR EQUITY, WHETHER FOR BREACH OF CONTRACT, TORT OR OTHERWISE, ARISING FROM THE GIFT CARDS OR YOUR USE OF THE GIFT CARDS OR ANY PRODUCTS OR SERVICES RELATED THERETO, INCLUDING DIRECT, INDIRECT, THIRD PARTY, INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY THEREOF. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, WALGREENS, ITS AFFILIATES, AND THEIR RESPECTIVE DIRECTORS, MEMBERS, OFFICERS, EMPLOYEES, AGENTS, AND VENDORS, SHALL NOT BE RESPONSIBLE TO YOU OR ANY THIRD PARTY FOR OR IN CONNECTION WITH: (i) YOUR USE OF ANY GIFT CARDS OR PRODUCTS OR SERVICES RELATED TO THE GIFT CARDS, OR (ii) ANY UNLAWFUL, UNAUTHORIZED, OR FRAUDULENT CONDUCT BY YOU OR BY ANY THIRD PARTY RELATED TO ANY GIFT CARD.

    CERTAIN STATE LAWS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY.

    ARBITRATION AGREEMENT AND PROHIBITION OF CLASS AND REPRESENTATIVE ACTIONS AND NON-INDIVIDUALIZED RELIEF. EXCEPT FOR DISPUTES THAT QUALIFY FOR SMALL CLAIMS COURT, ALL DISPUTES BETWEEN YOU AND WALGREENS, ITS AFFILIATES, OR DIRECTORS, MEMBERS, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, OR VENDORS OF WALGREENS OR ITS AFFILITIES THAT ARISE OUT OF OR IN CONNECTION WITH THESE GIFT CARD TERMS OR YOUR PURCHASE, USE, OR ACCEPTANCE OF ANY GIFT CARD, WHETHER THE DISPUTE IS BASED IN CONTRACT, TORT, STATUTE, FRAUD, MISREPRESENTATION, OR ANY OTHER LEGAL THEORY, WILL BE RESOLVED IN FINAL, BINDING, INDVIDUAL ARBITRATION BEFORE A NEUTRAL ARBITRATOR INSTEAD OF IN COURT BY A JUDGE OR A JURY. YOU AGREE THAT WALGREENS AND YOU EACH WAIVE THE RIGHT TO TRIAL BY A JURY AND THAT THE FEDERAL ARBITRATION ACT (“FAA”) AND FEDERAL ARBITRATION LAW, NOT STATE LAW, GOVERN THE ENFORCEABILITY OF THIS SECTION (despite the general choice of law provision set forth below). YOU ALSO AGREE THAT ANY ARBITRATION UNDER THESE TERMS WILL TAKE PLACE ON AN INDIVIDUAL BASIS; CLASS ARBITRATIONS, CLASS ACTIONS, AND MASS ACTIONS ARE NOT PERMITTED, AND YOU AGREE TO GIVE UP THE ABILITY TO BRING OR PARTICIPATE IN A CLASS ACTION.

    FOR ANY AND ALL DISPUTES OR CLAIMS YOU HAVE, YOU MUST FIRST GIVE WALGREENS AN OPPORTUNITY TO RESOLVE YOUR CLAIM BY SENDING AN INDIVIDUAL, WRITTEN DESCRIPTION OF YOUR CLAIM THAT DESCRIBES IN DETAIL THE INDIVIDUAL DAMAGES THAT YOU CLAIM TO HAVE SUFFERED TO WALGREENS’ REGISTERED AGENT AT THIS ADDRESS:

    You and Walgreens each agree to negotiate your claim in good faith. You agree that you may not commence any arbitration or court proceeding unless you and we are unable to resolve the claim within 60 days after we receive the claim description detailed above and you have made a good faith effort to resolve your claim directly with us during that time. If we are unable to resolve your claim within 60 days despite those good faith efforts, then either you or Walgreens may start an arbitration or small claims court proceeding. However, a court, not an arbitrator, will decide whether these conditions precedent have been satisfied.

    The arbitration of all disputes will be administered by the AAA under its Consumer Arbitration Rules in effect at the time the arbitration is commenced, except to the extent any of those rules conflicts with our agreement in these Gift Card Terms, in which case these Gift Card Terms will govern. The AAA's rules and a form for initiating arbitration proceedings are available on the AAA's website at: www.adr.org. opens in a new tab If AAA fails or declines to conduct the arbitration for any reason, we will mutually select a different arbitration administrator. If we cannot agree, a court will appoint a different arbitration administrator but will not decide arbitrability or any other aspect of the parties’ dispute (except as outlined above or if either party files a small claims court matter). Payment of all filing, administration, and arbitrator fees will be governed by the AAA’s rules. Notwithstanding the foregoing, if any claim asserted in an arbitration demand is deemed to be frivolous, the defending party shall be entitled to recover its attorneys’ fees and any filing, administration, and arbitrator fees incurred. The arbitrator may award any individual relief a court of law could, including temporary, interim, or permanent injunctive relief on an individual basis.

    If a court or arbitrator finds in any action between you and us that any part of this section is unenforceable with respect to any claim, then the arbitration agreement and class action waiver will not apply to that claim, but they will still apply to any and all other claims that you or we may assert in that or any other action. If any provision of this section provision is found unenforceable, the other parts of it shall continue to apply. You reserve your ability to bring claims in small claims court to the extent of that court’s jurisdiction. If a claim proceeds in court rather than through arbitration, YOU AND WE EACH WAIVE ANY RIGHT TO A JURY TRIAL.
  12. GOVERNING LAW. The laws of the state of Illinois, without regard to principles of conflict of laws, apply to these Gift Card Terms and use of your Gift Card. If any part of these Gift Card Terms is unlawful, void, or unenforceable, that part will be deemed severable and will not affect the validity and enforceability of any remaining provisions.
  13. CHANGES TO TERMS. Walgreens reserves the right to change these Gift Card Terms from time to time in its discretion without special notice to you. Notice of changes will be by reasonable means, which may be by the posting of the revised version of these Gift Card Terms on this website (“Updated Terms”). Your use of a Gift Card after Walgreens has posted the Updated Terms constitutes your agreement to the Updated Terms. The Updated Terms will be effective as of the time of posting, or such later date as may be specified in the Updated Terms and will apply to your use of a Gift Card from that point forward. The date of the last update to these Gift Card Terms is always indicated near the top of the page and any change in the date of these Gift Card Terms shall constitute notice to you that the Gift Card Terms have changed.
  14. ADDITIONAL TERMS.
